Surveillance footage, staffing records, and the venue’s history of prior incidents are the strongest forms of evidence in these cases.

How Nevada Law Affects Your Nightclub or Bar Injury Case

Nevada premises liability law requires property owners to exercise reasonable care to protect visitors from foreseeable harm, including criminal activity on their premises. A nightclub or bar that knows its venue has a history of violence and does nothing to address it has breached that duty.

NRS 651.015 creates a heightened duty of care for hotels and casinos, which extends to nightclubs and bars attached to or operated within those properties. Venues on the Strip and in the major casino resorts face a stricter standard than a standalone neighborhood bar because of this statute.

Under the doctrine of respondeat superior, a venue is liable for injuries caused by its employees when they are acting within the scope of their employment. Any employee whose negligent or intentional conduct injures a patron can expose the entire business to a civil claim.

Modified comparative negligence under NRS 41.141 reduces your compensation by your percentage of fault in the incident. If a jury determines that your share of fault exceeds 50 percent, you are barred from recovering any damages. Insurance companies frequently argue that the injured patron was intoxicated, provoked a confrontation, or ignored visible hazards to shift fault away from the venue and onto you.

Who Can Be Held Liable for a Nightclub or Bar Injury?

What Should You Do After an Injury at a Las Vegas Nightclub or Bar?

Do not give a recorded statement to the venue’s insurance company before speaking with an attorney. Adjusters are trained to frame questions in ways that shift fault onto the injured patron.

Can You Sue a Bar for Over-Serving Alcohol in Nevada?

In most cases, no. Nevada is one of the few states that does not recognize dram shop liability for licensed establishments serving adults. NRS 41.1305 provides that the consumption of alcohol, not the act of serving it, is the proximate cause of any resulting injuries. A bar, nightclub, or casino that over-served an adult patron is generally not liable for the injuries that patron causes after leaving or while still on the premises.

The only exception applies when a licensed establishment knowingly serves alcohol to a person under 21 years of age. In that narrow circumstance, the venue can face civil liability for the harm that follows.

Many law firm websites list over-serving as a basis for suing a bar in Nevada. That claim is misleading. Dram shop immunity under NRS 41.1305 blocks it for adults in virtually every scenario.

Your claim survives through a different legal theory. Dram shop immunity does not shield a venue from premises liability or negligent security claims. If you were injured by an intoxicated patron at a bar, your claim targets the venue’s failure to maintain safe conditions or provide adequate security, not the act of serving alcohol.
