Las Vegas Underinsured Motorist Lawyer

A serious car accident often leads to far more than physical pain. Medical bills start to build, paychecks stop coming in, and the financial pressure grows quickly. Most people assume the at-fault driver’s insurance will cover these losses. In Nevada, that assumption can be risky. State law allows drivers to carry very low minimum liability coverage, and in many cases, those limits are not nearly enough to cover the full extent of the harm caused.

This is where underinsured motorist (UIM) coverage can become critical. If your injuries and expenses go beyond what the other driver’s policy covers, your own insurance policy may provide additional compensation. These claims can be difficult, especially when your insurer starts to push back. At Drummond Law Firm, we help clients assert their rights under their own policies, manage negotiations with providers, and fight for a resolution that truly reflects the losses they have suffered.

Veteran-Led Legal Advocacy That Prioritizes Recovery Over Red Tape

An underinsured motorist claim often feels like a second fight, especially when you are dealing with your own insurance provider. The claim may be valid, the policy may be clear, but the process still becomes a struggle. At Drummond Law Firm, we approach these cases with clarity, structure, and trial-ready preparation. Our focus is not just on reaching a settlement, but on ensuring the result matches the real impact of the crash.

We believe that legal representation should provide confidence, not confusion. Our firm combines military discipline with personalized service to guide clients through the most complex insurance challenges with clarity and purpose.

Built on Military Discipline and Courtroom Experience

Craig W. Drummond, our founding attorney, served as a Captain and JAG attorney in the U.S. Army. His work included legal duties during combat in Iraq, where he was awarded the Bronze Star Medal. The same level of preparation, focus, and integrity carries through to every case we handle. We build legal strategies methodically and approach every case with the expectation that it could go to trial. That mindset helps us uncover facts, prepare documentation thoroughly, and respond to insurance resistance with strength and structure.

The Only Reduced Fee Guarantee in Nevada

Too often, injury victims discover that their attorney collected more than they did from a settlement. We do not allow that to happen. Our Reduced Fee Guarantee® ensures that our fee will never exceed your net recovery. This means you will always receive more compensation than our firm. That is how we prioritize your outcome over our own.

You Always Speak With an Attorney—Not a Case Manager

From the first phone call, you will speak directly with a licensed attorney. Our team does not hand your claim to a case manager or rely on assistants to explain your legal rights. Your questions deserve real answers, and your case deserves direct attention from someone with the authority to take action. That structure ensures your case moves forward without unnecessary delays and with full transparency at every stage.

What Is Underinsured Motorist Coverage in Nevada?

Underinsured motorist coverage is a form of protection that helps you recover compensation when the driver responsible for the crash does not have enough liability insurance to cover your losses. It is an optional coverage in Nevada, but it can be one of the most important parts of your auto policy.

Is Underinsured Motorist Coverage Required in Nevada?

Nevada does not mandate UIM coverage, but insurers must offer it and you can waive it only in writing – so many drivers carry it without realizing.

– Check your declarations page; UIM is often included unless you signed a rejection.
– It protects you as a driver, passenger, pedestrian, or cyclist hit by an under-insured driver.
– We review every household policy to find all available coverage.

Nevada Minimum Coverage Limits Are Often Not Enough

Drivers in Nevada are only required to carry liability limits of $25,000 per person and $50,000 per accident. These amounts may not go far in a crash involving broken bones, surgery, physical therapy, or long-term disability. A single ambulance ride and hospital stay can exceed that limit within hours.

If the at-fault driver does not have enough coverage to pay for your full damages, your own UIM policy may cover the difference. The goal is to make you whole—to ensure that your expenses, injuries, and future needs are addressed in full, not capped by someone else’s low-cost policy.

The Difference Between Uninsured and Underinsured Claims

Uninsured motorist claims arise when the at-fault driver has no insurance at all. These cases are common in hit-and-run crashes or when the other driver is operating illegally. Underinsured claims, on the other hand, involve drivers who do have coverage, but not enough to cover the cost of your injuries and losses.

In both cases, the source of recovery often becomes your own insurer. And in both cases, your provider may attempt to minimize or dispute your claim. That is why legal guidance matters. We help ensure that the facts are clear, the paperwork is complete, and the damages are properly calculated and supported.

When Your Own Policy Becomes the Source of Recovery

You pay monthly premiums for coverage. When a crash occurs, and your injuries exceed the other driver’s limits, you may assume your insurer will step up. Unfortunately, that is not always how it plays out. Many providers begin to question your medical records, downplay the severity of your condition, or suggest that some of your treatment was unnecessary.

We manage this process from the beginning. Our firm handles communication, protects your rights, and makes sure the insurance company understands the full value of your claim. That includes everything from medical treatment and lost income to emotional and physical hardship.

How Underinsured Motorist Claims Work

A UIM claim follows a specific process, beginning with a review of both the at-fault driver’s insurance and your own policy. From there, it becomes a matter of documenting your losses, calculating the amount of compensation still owed, and submitting a claim for the difference. But these steps must be done with care. Your insurer may look for reasons to reduce or deny the claim altogether.

Identifying Policy Limits and Coverage Availability

The first step is confirming what coverage exists. That includes reviewing the liability limits of the at-fault driver and verifying the terms of your own UIM policy. Our team collects the declarations, compares policies, and determines how much additional compensation may be available. We also review the total medical bills, lost earnings, and any long-term treatment needs that are not covered by the other party’s insurer.

Initiating a Claim With Your Own Insurance Provider

Once we determine that a UIM claim is needed, we prepare a formal demand to your insurance provider. This document outlines what happened, what losses have occurred, and how the other driver’s policy falls short. We include full medical records, invoices, and supporting documentation. The insurance company is then expected to evaluate the claim and respond. If that response falls short, we prepare to escalate the case.

Resolving Disputes Over Medical Costs and Damages

Insurers often challenge UIM claims by disputing the value of your care, arguing that certain treatments were unrelated to the crash, or minimizing how your injuries affect your life. Our firm pushes back by working with medical experts, collecting follow-up documentation, and laying out your damages clearly. If the provider continues to undervalue your claim, we are prepared to move forward with litigation.

Common Scenarios That Trigger UIM Claims in Las Vegas

UIM claims are not rare or theoretical. They happen in real crashes involving real people—and they happen often in Nevada. Our firm has handled dozens of cases where UIM coverage became the only option for financial recovery.

Severe Injuries Exceeding Policy Limits

When a crash causes lasting harm, it does not take much to exceed a basic liability policy. Even a single surgery, rehabilitation program, or short-term disability can push past the $25,000 limit. UIM coverage makes up the difference between what was paid and what is still owed.

Multi-Vehicle Collisions With Shared Fault

If more than one driver is responsible, or if several vehicles are involved, the insurance payouts may be split. This means each insurer only pays a portion of the damages. If those combined payments still do not meet your needs, UIM coverage can close the gap.

Hit-and-Run Accidents With Unidentified Drivers

When a driver flees the scene and cannot be identified, you may be left with no third-party insurer to pursue. In these situations, UIM or UM coverage becomes your primary path to recovery. But these cases require swift and specific action to preserve your right to claim.

Crashes Involving Rideshare or Delivery Vehicles

Drivers working for rideshare apps or delivery services often carry limited or complicated insurance policies. If those policies do not apply, or the driver was between shifts, you may need to turn to your own UIM coverage to be made whole.

Types of Injuries That Often Require Additional Compensation

Underinsured motorist coverage becomes especially important when a crash leads to serious or long-term injuries. Basic liability policies are often exhausted quickly when emergency care, surgery, or permanent damage is involved. These cases require additional compensation to cover extended treatment, lost earning potential, and the emotional toll that comes with a life-altering injury.

Traumatic Brain and Spinal Injuries

Brain injuries and spinal cord trauma often require more than just initial stabilization. These injuries can affect memory, mobility, speech, and balance. Many clients face months of therapy, expensive medication, and uncertainty about their long-term prognosis. Even with good insurance, the other driver’s policy will likely not cover the full scope of care needed. UIM coverage helps bridge the gap between limited coverage and long-term need.

Broken Bones and Surgical Recovery

Orthopedic injuries may sound routine, but they frequently involve more than a cast and follow-up visit. Surgeries, implants, and extended physical therapy are common, and complications such as nerve damage or joint immobility can prolong recovery. These costs add up quickly, and when fractures involve weight-bearing bones, the impact on your job and daily life can be substantial.

Chronic Pain and Disability

Some injuries never fully heal. Clients often experience recurring headaches, lower back pain, or nerve-related symptoms for months or years after a crash. This kind of long-term suffering is rarely accounted for by minimum insurance policies, especially when the at-fault driver carried only the state-required limits. UIM benefits can help cover long-term treatment and reflect the true cost of living with lasting impairment.

Emotional Trauma and PTSD

Not every injury is physical. After a serious crash, many people struggle with anxiety, sleep disturbances, or depression. They may fear driving again, have flashbacks to the moment of impact, or experience emotional distress that affects work and family life. These emotional consequences are compensable under Nevada law, but they are often dismissed by insurers unless documented and supported. Our firm makes sure this harm is acknowledged and addressed.

Challenges in Dealing With Insurance Companies

Many people assume that filing a claim with their own insurance provider will be simple. After all, this is coverage you paid for and relied on to protect you. But UIM claims often result in unexpected resistance. Insurance companies, even your own, are focused on limiting payouts. They use a variety of tactics to delay or deny compensation, leaving victims frustrated and financially vulnerable.

What Should I Do if My UM/UIM Claim Is Denied in Nevada?

If your own insurer denies or lowballs a UM/UIM claim, you can dispute it, and a wrongful denial may expose the insurer to a bad-faith claim.

– Common denial reasons – late notice, disputed injuries, or the insurer arguing the other driver was adequately insured – can each be challenged.
– Nevada law requires insurers to handle claims in good faith; unreasonable denials can add penalties beyond the policy limit.
– We handle all insurer communication so your own carrier cannot use your statements to shrink the claim.

Delays and Bad Faith Denials

Insurance providers often stall when processing UIM claims. They may repeatedly ask for documents, claim they need more time to evaluate medical records, or argue that further investigation is required. These delays are sometimes strategic. They can put financial pressure on the injured person and push them to accept less than they deserve. In some cases, insurers deny valid claims entirely, claiming that the policy does not apply or that the treatment was unrelated to the crash.

Misrepresentation of Policy Terms

Another common issue involves misrepresentation. Some insurers downplay what the UIM coverage actually provides. They may claim that limits do not apply to your situation or argue that coverage is secondary when it should be primary. Without a strong legal team reviewing the policy and pushing back, clients are often misled or confused into accepting less than what the policy truly covers.

Lowball Settlement Offers From Your Own Insurer

When insurers do make an offer, it often falls far short of what the claim is worth. They may argue that your injuries are minor, that you recovered faster than expected, or that some of your care was unnecessary. These assessments are rarely accurate. Our firm documents every cost, projects future needs, and presents your full claim in a way that is difficult to dispute. We negotiate firmly and, when needed, prepare to litigate.

How Drummond Law Firm Builds and Fights UIM Claims

Underinsured motorist claims require a proactive, structured legal approach. These are not standard insurance disputes. The stakes are high, the process is adversarial, and the burden falls on you to prove your losses. At Drummond Law Firm, we do that work for you. From the start, we gather the evidence, develop the case strategy, and make sure your insurer knows we are prepared to take the claim all the way to court if needed.

Can I Stack UM/UIM Coverage in Nevada?

Yes. Nevada allows UM/UIM coverage to be stacked across multiple vehicles on a policy, which can substantially raise the limits available to you.

– Stacking multiplies the per-vehicle UIM limit by the number of covered vehicles.
– Umbrella policies and other household policies may add further coverage.
– We audit every policy in the household to find all stackable limits.

Thorough Case Evaluation and Medical Review

We begin by examining every aspect of your injuries. This includes collecting medical records, reviewing treatment plans, and speaking with your care providers. If your condition is expected to continue or worsen, we document that timeline. We also assess the financial impact—current bills, out-of-pocket costs, and the resources you will need to continue recovery.

Expert Testimony and Financial Impact Calculations

In many UIM cases, the value of your claim depends on expert input. We work with economists, medical experts, and vocational consultants who can explain the long-term cost of your injuries. This includes lost income, reduced earning potential, future surgeries, or the need for in-home assistance. These calculations make your case stronger and harder to dispute.

Litigating When Insurers Refuse to Pay Fairly

When negotiation fails, we do not hesitate to take the next step. Our firm is built around litigation, not settlements for convenience. We file lawsuits when necessary and present your case clearly in court. Our experience in the courtroom often leads to better settlement terms before trial even begins—but we never back down when the facts support your claim.

This firm, the staff and Craig Drummond are amazing! They are efficient, pleasant, professional and highly responsive. I worked in the legal field during my career span and truly appreciate the knowledge of Mr. Drummond. I recently was assisting a family member with some legal concerns and reached out to Mr. Drummond and Ximena for guidance. Although he does not practice in this area, he got back to me the very next morning - less than 10 hours later after emailing him at 10pm. He gave very sound and detailed advice and guidance. He also was kind enough to offer referrals to trusted attorneys in the field. I truly am grateful that I have had the opportunity to meet and deal with Craig Drummond, Esq. and consider myself so fortunate. Aloha, B.J. Souza

Craig Drummond and all of his staff are fantastic people to work with. I was involved in an accident where I was rear-ended by someone in a company vehicle that resulted in a traumatic brain injury. The personal attention that I received and the recommended Medical treatment was invaluable to me. My vehicle was totaled as I was pushed into the SUV in front of me. My award from the judge was in the seven figures. I highly recommend his law firm for any type of injury case somebody might have
