Blind Spot Truck Accident Lawyer Las Vegas

If you have been injured in a blind spot truck accident in Las Vegas, the attorneys at Drummond Law Firm will fight to recover the compensation your case deserves. Blind spot collisions between commercial trucks and passenger vehicles cause catastrophic injuries because an 80,000-pound truck generates force that a car cannot absorb.

If a truck driver failed to check mirrors before changing lanes or merged without signaling, you may be entitled to compensation. You may also have a claim if the driver was operating while fatigued. With more than 20 years of trial experience, our attorneys offer a free consultation to evaluate your claim. Call (702) 366-9966.

Blind Spot Truck Accident Attorneys Serving Las Vegas

Drummond Law Firm represents blind spot truck accident victims throughout Las Vegas with direct, attorney-led legal representation. Every client works with a licensed attorney who handles both the federal and state dimensions of your case, from FMCSA regulation analysis to Nevada premises and negligence law. You will never be passed off to a paralegal for the decisions that count.

I-15, US-95, and the I-215 Beltway carry thousands of commercial trucks through Clark County every day. These corridors are where most blind spot collisions occur, particularly during lane changes in heavy traffic and construction zones.

Nevada’s truck and bus fatality rate reached 0.251 per 100 million vehicle miles traveled in 2021. That figure nearly doubled the 0.149 rate recorded just two years earlier. That year, 68 people died in truck and bus collisions across the state.

Craig Drummond has litigated truck accident and personal injury cases throughout Nevada and brings more than 20 years of trial experience to every case. As a former U.S. Army Captain and JAG attorney, he prepares every claim with the discipline that litigation against trucking companies and their corporate insurers demands.

Without an Attorney vs. With Drummond Law Firm

Without an attorney, you are negotiating against a trucking company that has already begun building its defense before you leave the hospital. Carriers send their own investigators to the crash scene within hours. Those investigators photograph the scene, interview witnesses, and download electronic data from the truck.

The insurer then contacts you with an early settlement offer designed to close the file before the full cost of your injuries is known.

With Drummond Law Firm, your case moves on the same timeline the trucking company does. We send preservation letters within 24 hours to protect the truck’s electronic logging device data, black box records, driver logs, and maintenance files.

We retain accident reconstruction experts who analyze the physical evidence alongside the electronic data. Craig Drummond’s military and JAG background prepares him for the federal regulatory analysis that blind spot truck cases require.

The Reduced Fee Guarantee ensures our attorney fee will not exceed your net recovery, and you will not pay a fee unless we win your case.

When the stakes are high, you need an attorney who’s already been tested under pressure.

Types of Cases We Handle in Las Vegas

Drummond Law Firm handles blind spot truck accident cases across every road and highway in Clark County. The type of collision and the position of your vehicle relative to the truck determine how your attorney builds the case.

Sideswipe collisions during lane changes are the most common blind spot truck accident. The truck driver moves into an adjacent lane without checking mirrors or signaling, striking a vehicle traveling alongside the trailer. On I-15 and the I-215 Beltway, where traffic moves at highway speed, a sideswipe from an 80,000-pound truck can push a car across multiple lanes. Vehicles are forced into barriers, medians, or oncoming traffic.

Wide-turn accidents occur when a truck swings left before making a right turn at an intersection. The right-side blind spot, which extends two full lanes, makes it impossible for the driver to see a vehicle that has pulled alongside the truck on the right. The trapped vehicle is crushed between the truck and the curb or forced off the road.

Merge and highway-entry collisions happen when a truck enters a highway or merges from a ramp without checking the blind spot on the merge side. Vehicles already in the travel lane have no time to react when a fully loaded commercial truck moves into their space.

Rear-end collisions caused by the front No-Zone occur in heavy traffic and work areas. The truck’s elevated cab blocks the driver’s view of vehicles directly ahead. When traffic stops suddenly, the truck cannot see or stop in time to avoid the vehicle in front of it.

How Nevada Law Affects Your Blind Spot Truck Accident Case

Nevada follows modified comparative negligence under NRS 41.141. Your recovery is reduced by your percentage of fault, and if a jury assigns you more than 50 percent responsibility, you are barred from recovering anything. Trucking companies use this rule aggressively in blind spot cases. They argue that you were driving in the truck’s No-Zone voluntarily and should have known the driver could not see you.

Your attorney must counter this argument with evidence that the truck driver violated a specific duty. Under 49 CFR § 393.80, every commercial truck must be equipped with properly positioned mirrors that provide adequate field of view on both sides.

A driver who fails to check those mirrors before changing lanes or who fails to signal has breached a federal standard. A driver operating in violation of hours-of-service rules that caused fatigue has also breached that standard. The violation is direct evidence of negligence in Nevada courts.

Nevada’s several liability rule under NRS 41.141(4) means each defendant pays only its own percentage of fault. Identifying every responsible party matters because the truck driver, the trucking company, the maintenance contractor, and the cargo loader may each carry separate insurance. Your attorney must name every liable defendant to access every available policy.

FMCSA violations can also open the door to punitive damages under NRS 42.005 when the carrier’s conduct was knowing or reckless.

What Are the Four Blind Spots on a Commercial Truck?

Commercial trucks have four distinct blind spots that the FMCSA calls No-Zones. A passenger vehicle inside any of these zones is invisible to the truck driver. A lane change or turn made without checking creates a collision the smaller vehicle cannot avoid.

Front No-Zone

The front No-Zone extends approximately 20 feet ahead of the truck cab. The elevated hood blocks the driver’s view of anything directly in front of the truck at ground level. Vehicles that cut in front of a truck and brake suddenly are inside this zone before the driver can react.

Front No-Zone crashes happen most often in construction zones and heavy stop-and-go traffic on I-15. Frequent lane merges put smaller vehicles directly ahead of trucks that need significantly more distance to stop.

Rear No-Zone

The rear No-Zone extends approximately 30 feet behind the trailer. Commercial trucks have no rearview mirror, which means the entire area behind the trailer is invisible to the driver. Following too closely places your vehicle entirely inside this zone, where the driver cannot see you and you cannot see the road ahead.

Backing accidents in loading docks, parking lots, and warehouse districts also fall within the rear No-Zone and frequently involve pedestrians and workers on foot.

Left-Side No-Zone

The left-side No-Zone covers roughly one lane from the driver’s door back to the middle of the trailer. The driver’s side mirror picks up more than the passenger side. Lane-change sideswipes on multi-lane highways are the most common left-side No-Zone accident. Fatigue and distraction reduce the likelihood that the driver checks this mirror before merging, and hours-of-service violations are a frequent contributing factor.

Right-Side No-Zone

The right-side No-Zone is the largest and deadliest blind spot on a commercial truck. It extends two full lanes wide along the entire length of the vehicle, from the cab door to the rear of the trailer. The passenger-side mirror provides the least coverage of any mirror on the truck, and the driver must physically lean across the cab to check it.

Right-side blind spot crashes produce the highest fatality rates of any No-Zone collision type. Wide right turns at intersections compound the danger because the truck’s turning arc sweeps across the full width of the zone, trapping vehicles and cyclists against the curb.

Who Is Liable for a Blind Spot Truck Accident?

Liability in a blind spot truck accident can extend well beyond the driver. Trucking accidents involve federal regulations, corporate employment relationships, and multiple layers of insurance that standard car accident cases do not. Your attorney investigates every party in the chain to determine who bears responsibility.

The truck driver is liable when a lane change or turn is made without the mirror and signal checks that federal law requires. A driver who violated federal hours-of-service limits and was too tired to check the blind spot before merging carries direct fault for the collision.

The trucking company is liable under vicarious liability for the driver’s on-duty negligence. The company may also face direct negligence claims. Hiring a driver with a poor safety record without conducting the background investigation required under 49 CFR § 391.23 is one basis. Pressuring drivers to skip rest periods to meet delivery deadlines is another. Failing to maintain the truck’s mirror and camera systems is a third.

Maintenance contractors are liable when improperly adjusted mirrors, broken blind spot cameras, or malfunctioning lane-departure warning systems contributed to the crash. Cargo loaders may share liability when an improperly loaded trailer shifted the truck’s weight distribution and affected the driver’s ability to maneuver safely during a lane change.

How ELD and Black Box Data Can Prove Your Case

Electronic logging devices and event data recorders capture the evidence that resolves blind spot fault disputes. This data allows your attorney to reconstruct exactly what the driver did in the seconds before the collision.

ELD data records the driver’s hours of service, duty status, and driving time. If the driver was operating beyond the hours permitted under 49 CFR Part 395 at the time of the crash, the data proves fatigue was a contributing factor. ELD systems also record vehicle speed and location, which your attorney can use to establish the truck’s position and movement leading up to the collision.

The truck’s black box, also called an event data recorder or electronic control module, captures a different layer of evidence. It records speed at the moment of impact, braking inputs, steering angle, throttle position, and whether the turn signal was activated before the lane change. If the driver changed lanes without signaling and without braking, the black box data proves the driver did not take the steps required to check the blind spot.

Carriers can overwrite or destroy this data within days of the crash. Your attorney must send a spoliation preservation letter immediately after the accident demanding that the trucking company retain all electronic data, driver logs, maintenance records, and dispatch communications. If the carrier destroys evidence after receiving this letter, the court can impose sanctions and draw adverse inferences against the company.

What Compensation Can You Recover?

Nevada law allows blind spot truck accident victims to recover economic, non-economic, and punitive damages. The available recovery in truck accident cases is substantially larger than in standard car accident cases because of the federal insurance requirements that govern commercial carriers.

Economic damages cover medical bills, surgical costs, rehabilitation, lost wages, and future medical treatment for injuries that require ongoing care. Blind spot truck collisions frequently produce traumatic brain injuries, spinal cord damage, and crushed limbs that generate medical costs extending years or decades into the future. Your attorney calculates these costs with the help of life care planners and medical experts.

Non-economic damages account for pain and suffering, emotional distress, disfigurement, and loss of enjoyment of life. Nevada places no cap on non-economic damages in truck accident cases.

Under 49 CFR § 387.9, interstate carriers hauling general freight must maintain at least $750,000 in liability insurance. Carriers transporting hazardous materials carry even higher minimums. The $750,000 floor is 30 times the $25,000 minimum required for Nevada passenger vehicles. The pool of available coverage in a truck accident case is dramatically larger from the start.

Punitive damages under NRS 42.005 may apply when the trucking company knowingly dispatched a fatigued driver, falsified driver logs, or ignored maintenance deficiencies that contributed to the crash. In wrongful death cases, the victim’s family may recover funeral expenses, lost financial support, and grief-related damages.

Steps to Take After a Blind Spot Truck Accident

Call 911 and request a police report that specifically documents the involvement of a commercial truck. The responding officer’s report should note the truck’s company name, DOT number, license plate, and the position of both vehicles at the time of the collision. This information identifies the carrier and connects your claim to the correct insurance policy.

Photograph the truck from multiple angles. Capture the mirrors, any blind spot cameras or warning systems mounted on the vehicle, and the company name and DOT number on the cab and trailer. Photograph the damage to both vehicles as well. Photograph the road, lane markings, and any construction zone signage that may have contributed to the lane-change conditions.

Collect contact information from every witness at the scene. In blind spot cases, witnesses who saw the truck change lanes without signaling provide testimony your attorney cannot replace. So do witnesses who saw your vehicle in the truck’s blind spot before the collision.

Seek medical attention on the same day even if your injuries appear minor. Truck collisions generate forces that produce internal injuries, soft tissue damage, and concussions that may not present symptoms immediately. A same-day medical record connects your injuries to the crash.

Do not give a recorded statement to the trucking company’s insurance representative before speaking with an attorney. Adjusters will ask you questions designed to establish that you were driving in the truck’s blind spot voluntarily, which supports a comparative negligence defense.

How Long Do You Have to File a Truck Accident Lawsuit in Nevada?

Nevada gives you two years from the date of the accident to file a personal injury or wrongful death lawsuit under NRS 11.190. Once that deadline passes, the court will almost certainly dismiss your case regardless of how clear the liability is.

The evidence preservation window is far shorter than the filing deadline. ELD data and black box records can be overwritten within days if your attorney does not send a preservation demand. Driver logs, dispatch records, and maintenance files are retained by the carrier for limited periods under federal rules.

The truck itself may be repaired, sold, or scrapped. Your attorney needs to inspect the mirrors, cameras, and warning systems before that happens.

The trucking company’s internal investigation begins within hours. Your attorney must move on the same timeline to secure the evidence that proves what the driver did and failed to do.

This firm, the staff and Craig Drummond are amazing! They are efficient, pleasant, professional and highly responsive. I worked in the legal field during my career span and truly appreciate the knowledge of Mr. Drummond. I recently was assisting a family member with some legal concerns and reached out to Mr. Drummond and Ximena for guidance. Although he does not practice in this area, he got back to me the very next morning - less than 10 hours later after emailing him at 10pm. He gave very sound and detailed advice and guidance. He also was kind enough to offer referrals to trusted attorneys in the field. I truly am grateful that I have had the opportunity to meet and deal with Craig Drummond, Esq. and consider myself so fortunate. Aloha, B.J. Souza
