What to Do After a Swimming Pool Accident in Las Vegas

Swimming pool accidents in Las Vegas produce serious and often permanent injuries, including near-drowning with brain damage and spinal cord injuries from diving into shallow water.

What you do in the hours after a pool accident affects both the injured person’s health and your ability to hold the property owner accountable. A child pulled from the water who appears fine may still be at medical risk. The steps you take now can protect their health and preserve the evidence your claim will need.

What Should You Do Immediately After a Swimming Pool Accident?

Call 911. If the victim is still in the water, remove them safely. If they are not breathing, begin CPR immediately if you are trained. Do not move a person with a suspected spinal injury unless they are in immediate danger of drowning.

Once emergency responders arrive and the victim is stabilized, report the incident to the property owner, hotel management, or HOA. Request a written incident report and ask for the names of every employee involved in the response. Do not leave the property without a copy of that report or written confirmation that one will be provided.

Do not give a recorded statement to the property owner’s insurance company before speaking with an attorney. Adjusters contact victims quickly after pool accidents, and their goal is to document statements that reduce the payout or shift fault.

While still at the scene, use your phone to photograph the pool area and the hazard that caused the injury. Capture the condition of all safety equipment before anything is cleaned up or repaired. If other people witnessed what happened, collect their names and phone numbers before they leave. Hotel guests and pool visitors check out and become unreachable within days.

Surveillance footage at hotels, resorts, and apartment complexes is typically overwritten within 30 to 90 days. Contact an attorney within days so that a preservation demand can be sent before the recordings are gone.

Why You Should Seek Medical Attention Even If You Feel Fine

Most advice about pool accidents stops at “seek medical attention” without explaining why it matters when the person appears healthy.

After any submersion incident, even one lasting only a few seconds, water can enter the lungs and irritate the lining of the air sacs. That irritation triggers inflammation and fluid buildup, a condition called pulmonary edema. As fluid accumulates, the lungs lose their ability to oxygenate the blood. Breathing becomes labored and oxygen levels drop.

This process is not instant. Symptoms can develop within 4 to 8 hours after the person has left the water and appears completely normal. Watch for persistent coughing, difficulty breathing, chest pain, unusual fatigue, vomiting, behavioral changes, or bluish skin. Any of these symptoms in the hours after a pool incident means an immediate trip to the emergency room.

If the person is completely symptom-free after 8 hours, complications from that submersion are very unlikely. But within that window, symptoms can escalate from a persistent cough to respiratory failure.

For parents whose child was briefly underwater at a hotel pool and is now walking and talking, the instinct is to believe everything is fine. The 8-hour observation window exists because the body does not always show the damage right away. An ER visit also creates a medical record that ties the injury to the pool accident, which is essential for any future claim.

When the stakes are high, you need an attorney who’s already been tested under pressure.

What Types of Swimming Pool Accidents Lead to Injury Claims?

Near-drowning is the most dangerous pool accident and often produces the largest settlements. When the brain is deprived of oxygen for even a few minutes, the result can be permanent anoxic brain injury that affects memory, cognition, movement, and speech. Survivors may require decades of full-time care.

Diving injuries occur when a person dives into water that is too shallow. Missing or obscured depth markers at hotel and resort pools contribute to spinal cord injuries and traumatic brain injuries that are preventable with proper signage.

Slip and fall injuries on pool decks result from wet surfaces, uneven pavers, broken tiles, and inadequate drainage. These injuries range from fractures and lacerations to head trauma.

Drain and suction entrapment happens when a pool’s drain cover is missing, broken, or non-compliant. The suction force can trap a child underwater and cause drowning in seconds. Federal law under the Virginia Graeme Baker Act requires compliant drain covers on all public pools, and a violation creates strong grounds for liability.

Chemical burns from improperly balanced pool water can cause skin irritation, eye damage, respiratory problems, and burns to mucous membranes. Electrical shock from faulty underwater lighting or pool equipment, while less common, can cause cardiac arrest and drowning.

Who Can Be Held Liable for a Swimming Pool Accident in Nevada?

The party who controlled the pool and failed to maintain safe conditions bears liability. In most cases, that is the property owner or operator, but multiple parties can share responsibility depending on the circumstances.

Hotels and resorts owe guests safe premises and adequate supervision where lifeguards are provided. A resort that advertises a supervised pool and then fails to staff a trained lifeguard during operating hours is liable for injuries that proper supervision would have prevented.

Apartment complexes and HOAs control the gates, fencing, and maintenance at community pools. A broken gate latch that allows a child to access the pool area unattended is one of the most common liability scenarios in Las Vegas residential drowning cases.

Private homeowners are liable when they fail to secure their pool with compliant barriers and a child gains access. Nevada applies the attractive nuisance doctrine, which holds property owners to a higher standard because children cannot appreciate the danger a pool presents.

Pool management companies hired to maintain water quality, inspect equipment, or provide lifeguards can be liable for negligent maintenance or staffing failures. Equipment manufacturers can be liable for defective drain covers, filtration systems, or electrical components. What Evidence Should You Collect After a Pool Accident?

Photograph everything before the property owner has a chance to clean up or repair the hazard. Capture the gate and its latch mechanism, the fence height and condition, depth markers, warning signs, and drain covers. Photograph the deck surface where someone slipped and any broken or missing safety equipment. Take wide shots of the entire pool area and close-ups of the specific hazard that caused the injury.

The incident report you requested at the scene, the employee names you recorded, and the witness contacts you collected form the foundation of your evidence file.

Preserve swimwear and any personal items involved in the accident. Keep all medical records, discharge paperwork, prescription documentation, and receipts for every expense related to the injury.

Your attorney should send a preservation demand to the property owner for surveillance footage, maintenance logs, chemical treatment records, inspection reports, and lifeguard schedules. These records reveal whether the property owner knew about the hazard and how long it existed before someone was hurt.

How Does Nevada Law Apply to Swimming Pool Injury Claims?

Pool accident claims in Nevada fall under premises liability law. Under NRS 41.130, property owners have a legal duty to maintain reasonably safe conditions for anyone lawfully on their property. A hotel guest, an apartment tenant, and a child invited to a neighbor’s pool are all owed that duty of care.

Clark County enforces specific pool barrier codes that carry legal weight in court. Residential pools must be surrounded by a fence at least 60 inches high with gaps no wider than 4 inches. Gates must be self-closing and self-latching, with the latch positioned at least 54 inches above the ground. A property owner who violates these codes and allows a preventable injury faces negligence per se, meaning the violation itself establishes fault.

Modified comparative negligence under NRS 41.141 allows the property owner to argue that the victim shares some of the blame. The insurer may claim the victim was intoxicated, ignored posted pool rules, or dove recklessly into shallow water. If the victim’s share of fault exceeds 50 percent, no compensation can be recovered.

Nevada gives you two years from the date of injury to file a personal injury lawsuit under NRS 11.190(4)(e). Wrongful death claims after a fatal drowning carry their own two-year period under NRS 41.085.

What Compensation Can You Recover?

Pool accident victims in Nevada can pursue economic, non-economic, and punitive damages. Economic damages cover emergency room treatment, ICU stays, surgery, respiratory therapy, rehabilitation, and long-term cognitive therapy for brain injury survivors. Home health care and lost wages for injured adults and caregiving parents are also recoverable.

Non-economic damages account for pain and suffering, emotional distress, and loss of enjoyment of life. Catastrophic pool injuries are valued around a lifetime of care. Pediatric brain injuries from near-drowning and spinal cord injuries from diving require testimony from life care planners and medical experts. Nevada places no cap on non-economic damages in personal injury cases outside of medical malpractice.

Punitive damages may apply when the property owner knew about the hazard and did nothing. A resort that received guest complaints about a broken gate latch and continued operating the pool without a repair faces punitive exposure.

This firm, the staff and Craig Drummond are amazing! They are efficient, pleasant, professional and highly responsive. I worked in the legal field during my career span and truly appreciate the knowledge of Mr. Drummond. I recently was assisting a family member with some legal concerns and reached out to Mr. Drummond and Ximena for guidance. Although he does not practice in this area, he got back to me the very next morning - less than 10 hours later after emailing him at 10pm. He gave very sound and detailed advice and guidance. He also was kind enough to offer referrals to trusted attorneys in the field. I truly am grateful that I have had the opportunity to meet and deal with Craig Drummond, Esq. and consider myself so fortunate. Aloha, B.J. Souza

Craig Drummond and all of his staff are fantastic people to work with. I was involved in an accident where I was rear-ended by someone in a company vehicle that resulted in a traumatic brain injury. The personal attention that I received and the recommended Medical treatment was invaluable to me. My vehicle was totaled as I was pushed into the SUV in front of me. My award from the judge was in the seven figures. I highly recommend his law firm for any type of injury case somebody might have
